Terms and conditions of sale
All sales made by Cake Empire are subject to the following terms and conditions. These terms do not affect your statutory rights as a customer.

The following constitutes a legal agreement between a visitor (“ you”) and us with respect to our website service, the terms of which are set out below. You must be 18 years of age to agree and to enter into this agreement on your own behalf and to register to use this site. If you’re under 18 but at least 15 years of age, you must present this agreement to your parent or legal guardian. Children under the age of 15 are not permitted to register on this site and parents or legal guardians may not register on their behalf.

Price & Payment
The price to be paid by you for any products will be stated on your order form if offline or on our website if online. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an invoice. All credit/ debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses or does not authorise payment to us we will not be deemed liable for any delay or non-delivery of products ordered.


All of our cakes contain butter (dairy), gluten (wheat) and eggs, unless otherwise stated. Products containing nuts will be explicitly listed. However all our products are made in an environment which handles nuts. Please contact us regarding any special dietary requirements.

Deposits for Wedding cakes and other bespoke cakes

All cake orders require a 50% non-refundable deposit of the total cost of the cake. The final balance is payable two weeks (14 days) prior to delivery/collection. However if your order is less than two weeks (14 days) from the pickup date you will be required to pay the total cost of the cake upfront. Payment can be made either by BACS payment or by PayPal. Orders are deemed to have been accepted only once the deposit has been paid.


In the event of non-payment after the initial deposit, the order will not be completed or released until payment is paid in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. Cake Empire accepts no responsibility for non-delivery under these circumstances.

Wedding cake consultation

Wedding cake consultations are arranged by appointment only and are priced at £25 for the hour. The £25 fee is non-refundable. The consultation includes three cake samples and fillings from our menu chosen by you, whilst any additional flavours are at an additional cost. However, if you decide to choose Cake Empire to create your wedding cake the price of the consultation will deducted from the total cost of the cake, subject to the condition that the overall price of your cake is over £500.

Order Alterations

Please check your order carefully and let us know of any changes within 3 days of order confirmation. Cake Empire reserves the right to vary the quoted fee in the event the customer requests changes to the agreed work. Whilst every effort will be made to accommodate any changes, they cannot always be guaranteed.


Your orders can be collected from main Peckham, South East London location at a prearranged time. A signature is required upon collection confirming you have received your order in acceptable condition and as specified. We will provide you with the necessary assembly instructions. Extreme care should be taken during transportation. The cake must be positioned on a flat surface within your vehicle (such as the boot), and so should not be placed on the seats. Sudden braking, sharp turns and pot holes must be avoided as practically possible. Weather conditions must also be taken into consideration. If it’s a warm day, ensure you have the air conditioning on throughout the journey. Please note that once the product has been collected, full responsibility for the product lies with the client. Cake Empire assumes no responsibility for any damage that may occur once it has left the premises.


Orders can also be delivered by prior arrangement with us. This service will incur a charge and delivery times are subject to availability, however, we will do our best to accommodate your requirements. It is the customer’s responsibility to ensure we have the correct delivery information and that someone is available to accept the delivery. A signature, confirming receipt will be required upon delivery. If the recipient is not available to collect the delivery, the order will be returned to Cake Empire. We will then contact you to arrange an alternative delivery or collection time. This will incur an additional charge which will be payable by the customer.

Delivery & Setting up

In addition to our delivery service, we are able to offer a setup service where required. The delivery and set up of our cakes is carried out by one or more of our skilled and professional staff. As part of this service, we will deliver and set up your cake as agreed, and ensure it is displayed at its best. Please ensure you have provided us with all relevant set up details and arrangements made with the venue for the location and display of your cake. Cake Empire will require a signature from the venue management confirming the cake has been received and set up in good condition. A photograph of the cake will be taken prior to departure by Cake Empire to verify this. Once the cake has been signed for, we are unable to accept liability for any interference with or damage to the cake thereafter. Please remember that chocolate covered or butter-creamed cakes can melt in warm conditions, such as inside a marquee or on a hot summer’s day or when set up in direct sunlight.


For all of our cake orders, the deposit payment is non-refundable in the event of a cancellation. In addition, depending on the amount of work carried out until that point, in accordance with your order, a further fee may be chargeable. For cancellations within the last 14 days before the due date, the full balance will be payable. All cancellations must be made in writing.

Returns Policy

We do hope that you will be pleased with your purchase. However, if upon collection or delivery of the Products you find that they are not correct (for example, the colour or wording is incorrect), or the order is incomplete, or a Product is in a damaged condition when you receive it, please notify us immediately by telephone on 0796 3324 629. If the product is not the same description as on the invoice or damaged we will refund your purchase upon return of damaged goods.

Publications and promotional rights

We reserve the right to use any image of a customer’s cake made by Cake Empire for publication after the delivery date unless previously agreed in writing between the customer and Cake Empire.

Our right to vary these Terms and Conditions

We have the right to revise and amend these Terms and Conditions from time to time, for example, to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

Cake Empire will not be taking on any orders after Saturday 20th July 2019
